1. Acceptance of terms

By accessing or using MortgageReady at mortgageready.co.nz (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

2. Description of the Service

MortgageReady is a New Zealand-specific mortgage readiness and home-buying affordability calculator. The Service allows you to build a financial profile, calculate borrowing power, generate affordability scores, upload documents, analyse bank statements, and produce reports β€” all based on the information you provide.

3. Not financial advice

The Service does not constitute financial, legal, or tax advice. All calculations, scores, and outputs are estimates based on general NZ lending rules and the data you enter. They are provided for informational and educational purposes only.

We are not a registered financial adviser under the Financial Markets Conduct Act 2013. Before making any financial decisions β€” including applying for a mortgage, drawing down KiwiSaver, or engaging a lender β€” you should consult a licensed mortgage adviser, financial adviser, or your bank directly.

Lending criteria, RBNZ rules, tax brackets, KiwiSaver withdrawal rules, and government scheme eligibility change regularly. While we endeavour to keep our calculations current, we do not guarantee they reflect the latest rules at any given time.

4. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement. The Service is designed for use by New Zealand residents and applies NZ-specific tax, lending, and regulatory rules.

5. Your account

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating your account and building your profile.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you become aware of any unauthorised use of your account.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to other users' accounts or data.
  • Upload malicious files, viruses, or harmful content.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated systems (bots, scrapers) to access the Service without our written consent.
  • Misrepresent your identity or impersonate another person.
  • Interfere with or disrupt the integrity or performance of the Service.

7. User content and data

You retain ownership of all data and documents you upload to the Service ("User Content"). By using the Service, you grant us a limited licence to process, store, and display your User Content solely for the purpose of providing the Service to you.

You are responsible for the accuracy of data you enter. Inaccurate inputs will produce inaccurate results. We are not liable for decisions made based on incorrect information you provided.

8. AI-generated content

The Service uses AI to generate certain content, including engagement letters and bank statement spending insights. AI-generated content is provided as a starting point and may contain errors or inaccuracies. You are responsible for reviewing and editing any AI-generated content before using it externally. We make no guarantees about the accuracy, completeness, or suitability of AI-generated outputs.

9. Premium features and payments

Some features of the Service may require a paid subscription or one-off purchase. Payments are processed by our payment provider, Polar. All prices are displayed in New Zealand Dollars (NZD) and include GST where applicable.

Refund requests are handled on a case-by-case basis. Contact us at support@mortgageready.co.nz if you believe you are entitled to a refund.

10. Intellectual property

The Service β€” including its design, code, calculations, content, and branding β€” is owned by MortgageReady and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

The mortgage glossary, affordability scoring methodology, and calculation logic are proprietary to MortgageReady.

11. Limitation of liability

To the maximum extent permitted by New Zealand law, including the Consumer Guarantees Act 1993:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind.
  • We do not warrant that the Service will be uninterrupted, error-free, or that calculations will always be accurate or up to date.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or NZD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless MortgageReady from any claims, losses, or damages arising from your breach of these Terms, your use of the Service, or any inaccurate information you provide.

13. Service availability and changes

We may modify, suspend, or discontinue any part of the Service at any time without notice. We will make reasonable efforts to notify users of significant changes, but are not obligated to do so. We are not liable to you for any modification, suspension, or discontinuation of the Service.

14. Account termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

15. Third-party links and services

The Service may contain links to third-party websites (such as TradeMe, Realestate.co.nz, OneRoof, and Kāinga Ora). We are not responsible for the content, accuracy, or practices of third-party websites. Your use of third-party services is governed by their respective terms and policies.

16. Governing law and disputes

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

17. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
